What is a Notary Public?
A Notary Public is a legal professional appointed by the Attorney General of Malaysia under the Notaries Public Act 1959. Typically, this role is held by an advocate and solicitor with at least 15 years of experience. Notaries Public are internationally recognized and authorized to authenticate and attest documents for use outside Malaysia.
A Notary Public in Malaysia can:
  • Witness the signing of agreements and letters
  • Certify true copies of documents such as passports, identity cards, birth and marriage certificates, academic transcripts, bank statements, and proof of address
  • Authenticate and attest documents, including issuing Notarial Certificates or Forms of Authentication
  • Administer oaths or affirmations for affidavits or statutory declarations intended for use outside Malaysia
Note: Notaries Public cannot administer oaths or affirmations for documents to be used in Malaysian courts.
A Notary Public is empowered by the Notaries Public Act 1959 and can notarize documents for international use, witness signatures, and certify true copies. In contrast, a Commissioner for Oaths, appointed under the Commissioners for Oaths Rules 2018, can only affirm documents for use within Malaysia and cannot witness signatures or certify true copies.

Yes, advocates and solicitors are legally permitted to witness signatures and certify true copies of documents. However, many authorities, including the Ministry of Foreign Affairs and embassies, may require notarization by a Notary Public instead.
